Property Stamp Duty & Registration Guide (India 2026)

Circle Rate vs Agreement Value (Section 56(2)(x))

Every state revenue department establishes minimum benchmark values known as Circle Rates (Delhi/UP), Ready Reckoner Rates (Maharashtra), or Guidance Values (Karnataka).

Under Indian tax law, stamp duty and registration fees are calculated on whichever value is higher. If you purchase a flat for ₹60 Lakhs but the circle rate evaluates to ₹65 Lakhs, duty must be paid on ₹65 Lakhs. Furthermore, under Section 56(2)(x), the ₹5 Lakh difference is treated as taxable 'Income from Other Sources' for the buyer if it exceeds a 10% tolerance band.

Women Homebuyer Stamp Duty Benefits

To encourage female homeownership, state governments offer statutory concessions:

  • Delhi: Women pay 4% stamp duty vs 6% for men (A direct 2% saving of ₹1,00,000 on a ₹50L home).
  • Maharashtra: 1% rebate on residential properties for female sole owners.
  • Gujarat: 100% waiver of registration fee (1% completely free) plus 1% stamp duty discount.
  • Haryana: 2% discount in urban areas (5% vs 7%).

How to Pay Stamp Duty in India

Physical non-judicial stamp paper has been largely phased out in favour of digital methods:

  • e-Stamping (SHCIL): Stock Holding Corporation of India issues tamper-proof certificates in Delhi, Karnataka, Gujarat, and UP.
  • e-SBTR / GRAS: Maharashtra uses Government Receipt Accounting System (GRAS) for electronic Secure Bank Treasury Receipts.
  • Kaveri 2.0: Karnataka enables complete online deed drafting and pre-registration fee collection.
